Developer / API / MCP Terms

These terms ("API Terms") govern your use of Swaps' developer surfaces — agent.swaps.app, the @agent.swaps/mcp-server npm package, the ChatGPT mini app's tools, and any other programmatic interface to the Swaps service (collectively, "Developer Surfaces"). They supplement the Terms of Service and, in case of conflict for matters specific to Developer Surfaces, control.

By using a Developer Surface, you agree to these terms. If you are accessing a Developer Surface on behalf of an organisation, you confirm you have authority to bind that organisation.

The endpoints are documented at agent.swaps.app and in the package README. Documentation is the authoritative reference for available endpoints, parameters, and response shapes at any given time.

2. Permitted use

You may use the Developer Surfaces to:

  • Build AI agents, chatbots, comparison tools, and analytics dashboards that surface Swaps data to end users.
  • Power read-only crypto information features in your own products, with attribution.
  • Educate users about crypto prices, providers, country coverage, and routing.
  • Develop internal tooling for legitimate business purposes.

3. Prohibited use

You may not:

  • Use the Developer Surfaces to execute transactions automatically based on AI output without a human-in-the-loop confirmation step. See the AI Disclosure §6 — AI-generated quotes can be hallucinated, and automated execution multiplies the harm.
  • Embed API keys or secrets in client-side code shipping to end users.
  • Resell, sublicense, or re-distribute access to the Developer Surfaces (e.g., proxy them behind your own paid API tier) without our prior written agreement.
  • Misrepresent the source of the data. If you display Swaps data, you must attribute it to Swaps in a manner reasonably visible to the end user.
  • Use the Developer Surfaces to compete with the Service in a way that involves systematic scraping, copying our taxonomy, or re-publishing our data as if it were yours.
  • Use the Developer Surfaces in violation of the Acceptable Use Policy, the Sanctions policy, or any law.

We reserve the right to tighten limits in response to abuse. Sustained breaches (more than 100 × 429 responses per hour from one IP) result in IP-level blocks.

If your legitimate use case requires higher limits, email hello@swaps.app to discuss. A commercial tier with higher limits is not currently offered but may be in the future.

5. Quotes are still previews

Quotes returned by the Developer Surfaces are previews based on Provider data refreshed every ~30 seconds, exactly as on the Service. The binding quote is the one the Provider gives at its checkout — see the Terms of Service §4.3 and the Risk Disclosure §3.

If you build a product that surfaces quotes to end users via the Developer Surfaces, you must make clear to your end users that the quote is a preview, not binding, and that the actual transaction is with the Provider, not with you and not with Swaps. We recommend reproducing the substance of the Risk Disclosure §3 (Quote and rate risk) in your interface.

The public ChatGPT Apps Directory V1 does not expose quote or checkout tools. If a user asks for a crypto purchase quote, checkout link, payment, transfer, or trade through that public ChatGPT app, the tool response should state that the request is outside the public V1 scope rather than generating a quote or link.

6. Attribution

If you display Swaps data in a product or surface:

  • Attribute Swaps as the source in a reasonably visible place: "Data via Swaps.app" or "Powered by Swaps" is sufficient.
  • Where you reproduce more than incidental amounts of taxonomy data, link back to www.swaps.app or to the relevant Swaps page.

You may use the "Swaps" name and logo for attribution purposes in line with the Brand Hub guidance. Do not use them in a way that implies partnership, endorsement, or affiliation beyond use of the API.

7. AI agents — additional duties

If your product is an AI agent that consumes Swaps data and acts on behalf of end users:

  • Human-in-the-loop required for transactions. Do not chain Swaps' quote/routing output into automated trade execution without explicit user confirmation per transaction.
  • Disclose AI use. Tell end users that the agent uses AI, that AI can be wrong, and that they should verify before relying on the agent's output (consistent with the AI Disclosure).
  • Pass the rate-accuracy warning. Tell end users that quotes are previews.
  • Do not store user PII in your prompt context for longer than needed for the current session, unless you have explicit user consent.

8. Service availability and changes

The Developer Surfaces are provided "as is" and "as available". We may modify, deprecate, or remove endpoints at any time. We aim to provide 30 days' notice for breaking changes via the agent.swaps.app changelog and via npm package release notes, but we cannot commit to any uptime SLA on the free tier.

9. No warranty, no liability for downstream harm

To the fullest extent permitted by applicable law:

  • The Developer Surfaces are provided without warranty. See the Terms of Service §15.
  • We are not liable for losses your end users incur as a result of using your product that consumes the Developer Surfaces. Your contract with your end users — not ours with you — governs your liability to your users.
  • Our liability to you is capped per the Terms of Service §16.

10. Termination

We may suspend or terminate your access to the Developer Surfaces at any time, with or without notice, for breach of these API Terms, the Terms of Service, the Acceptable Use Policy, or for security or operational reasons. You may stop using the Developer Surfaces at any time.

11. Indemnification

You indemnify Swaps for any claim, loss, or expense arising out of (a) your use of the Developer Surfaces, (b) your product's failure to comply with these terms, (c) end-user claims against you that allege harm caused by your product. See the Terms of Service §17 for the general indemnification clause.

12. Open-source MCP package

The @agent.swaps/mcp-server package is published on npm and licensed under the licence stated in its repository (currently MIT). Use of the source code is governed by that licence; use of the Developer Surfaces the package connects to is governed by these API Terms regardless of how you obtained the package.

13. Future commercial tier

We may, in the future, introduce a paid commercial tier with higher rate limits, SLAs, and additional endpoints. Current free use does not entitle you to any commercial-tier features. If a commercial tier is introduced, the free tier will continue to exist with then-current rate limits.
